These General Terms and Conditions of Sale, hereinafter the “GTC”, govern sales of products made on the sitewww.rodier.frby SAS RODIER to consumers acting for non-professional purposes.
Article 1 – Identity of the seller

Article 2 – Purpose, scope and acceptance
2.1 Purpose
These GTC define the rights and obligations of RODIER and the Consumer in connection with the online sale of the products offered on the Site.
2.2 Scope
These GTC apply to orders placed on the Site and delivered in the countries offered at the time of the order.
They apply in particular to deliveries in mainland France, in the European countries served by RODIER and, where applicable, in the other countries offered during the ordering process.
Where the Consumer resides in another Member State of the European Union, the choice of French law may not have the effect of depriving them of the protection afforded to them by the mandatory provisions of the law of their country of residence where these are applicable.
2.3 Acceptance
The GTC are accessible at any time on the Site.
Before the final validation of their order, the Consumer may read these GTC. Validation of the order implies their acceptance.
The applicable GTC are those in force on the date of the order.
RODIER reserves the right to amend these GTC at any time. Amendments do not apply to orders already validated.
Article 3 – Products
The essential characteristics of the products are presented on their product pages, in particular their composition, colour, cut, size and, where relevant, their care instructions.
RODIER takes the greatest care in producing and presenting photographs of its products.
Slight colour variations may nevertheless appear depending on the settings or brightness of the screen used. Such variations cannot, in themselves, constitute a lack of conformity.
Product offers are valid while stocks last.
In the event that a product becomes unavailable after validation of the order, RODIER will inform the Consumer as soon as possible and will refund the corresponding sums.
Article 4 – Prices
Product prices are shown on the Site in euros, inclusive of all taxes, excluding delivery costs.
The applicable delivery costs are indicated to the Consumer before the final validation of their order.
The total amount due is displayed before confirmation of the order.
The applicable price is the one displayed on the Site at the time the order is validated.
RODIER reserves the right to amend its prices at any time, without retroactive effect on orders already validated.
For destinations or payment methods involving a currency conversion, exchange fees or bank charges may be applied by the Consumer's bank, independently of RODIER.
Article 5 – Order
5.1 Ordering process
The Consumer selects the products they wish to purchase and adds them to their basket.
Before the final validation of the order, they may check the contents of their basket, the selected products, the quantities, the total price, the delivery costs as well as the information relating to delivery and payment, and correct any errors.
Final validation of the order entails an obligation to pay.
5.2 Customer account
Where the Site allows it, creating a customer account is not mandatory in order to place an order.
Certain features or services, in particular order tracking, the management of returns or exchanges, may nevertheless require identification of the Consumer.
5.3 Order confirmation
After validation of the order and authorisation of payment, a confirmation e-mail summarising the main details of the order is sent to the Consumer.
5.4 Unavailability
In the event that a product becomes unavailable after validation of the order, RODIER will inform the Consumer as soon as possible and will refund the product concerned as well as, where applicable, the delivery costs directly associated with it.
5.5 Refusal or cancellation of an order
RODIER reserves the right to refuse or cancel an order on legitimate grounds, in particular in the event of fraud or attempted fraud, a payment incident, an unresolved prior dispute or quantities ordered that are manifestly incompatible with personal use.
Article 6 – Payment
Payment is due at the time of the order.
The payment methods available are those offered on the Site at the time of the order.
Depending on the options offered, the Consumer may in particular use payment by bank card, electronic payment or an instalment payment solution.
Where instalment payment is offered, the specific applicable conditions are communicated to the Consumer before validation of their payment.
Transactions are secured by the payment providers used by RODIER.
RODIER does not retain the Consumer's full bank details.
Article 7 – Delivery
7.1 Delivery address
The products are delivered to the address indicated by the Consumer at the time of the order.
The Consumer is responsible for the accuracy and completeness of the information provided.
7.2 Dispatch and lead times
RODIER endeavours to dispatch orders within 24 working hours after validation of the order.
The delivery times indicated on the Site are estimates, except where a firm deadline is expressly stated at the time of the order.
In the absence of an agreed date or period, delivery takes place at the latest within the period provided for by the applicable regulations.
7.3 Delivery in mainland France
Home delivery: €6.90 for any order under €200. Delivery free from €200 of purchases.
Pick-up point delivery: €5 for any order under €200. Delivery free from €200 of purchases.
The indicative delivery time is 24 to 48 hours after dispatch, depending on the delivery method chosen.
7.4 Delivery in Europe
Orders to European countries served by RODIER are delivered to the home address.
Delivery costs are €10 for any order under €200.
Delivery is free from €200 of purchases.
Pick-up point delivery is not offered for orders shipped within Europe outside mainland France.
7.5 International delivery outside Europe
For the other countries served by RODIER, delivery costs are calculated automatically at the time of the order, depending in particular on the country of destination.
The applicable amount is communicated to the Consumer before the final validation of their order.
7.6 Delivery security
Certain home deliveries are secured by a QR code sent to the Consumer by e-mail, to the address provided at the time of the order, as well as by SMS to the telephone number provided.
Where this system is used, handover of the parcel is subject to presentation of this QR code.
For security reasons, the Consumer must never give their QR code to the delivery driver by telephone or before having the parcel in their possession. The QR code must be presented only at the moment the parcel is actually handed over.
7.7 Late delivery
In the event of late delivery, the Consumer has the rights provided for by the French Consumer Code.
They may in particular ask RODIER to make the delivery within a reasonable additional period and then, where the legal conditions are met, terminate the contract if delivery does not take place within that period.
7.8 Transfer of risk
The risk of loss of or damage to the products is transferred to the Consumer at the time when the Consumer, or a third party designated by them other than the carrier, takes physical possession of the products.
Article 8 – Right of withdrawal, returns and exchanges
8.1 Legal withdrawal period
In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the Consumer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to give reasons for their decision.
Where several products from the same order are delivered separately, the period runs from receipt of the last product.
8.2 Exercising the right of withdrawal
The Consumer may exercise their right of withdrawal:

by means of the withdrawal feature accessible on the Site;

from their customer account and the returns portal where available;

by means of the withdrawal form appended to these GTC;

or by any other unambiguous statement expressing their wish to withdraw.
The Consumer may also contact RODIER at the addresscontact@rodier.fr.
The withdrawal feature offered online is free of charge and gives rise to confirmation of the Consumer's request.
8.3 Return period
After informing RODIER of their decision to withdraw, the Consumer has a maximum period of 14 days to dispatch or return the products concerned.

Where RODIER provides a return label, the Consumer is invited to use this label and to follow the instructions given in their returns area.
8.5 Return costs – mainland France
RODIER covers one prepaid return per order placed in mainland France within the withdrawal period.
The return label is accessible from the returns journey offered to the Consumer.
Where a single prepaid label is provided for an order, any additional return relating to the same order may be made at the Consumer's expense.
8.6 Return costs – Europe
For returns made from European countries served by RODIER outside mainland France, the direct return costs are borne by the Consumer.
Where the label offered by RODIER is used, a flat-rate return fee of €10 applies.
These costs are deducted, according to the Consumer's choice, from the amount of their refund, their credit note or the value allocated to their exchange.
8.7 Returns from countries outside Europe
For returns made from a country outside mainland France and outside Europe, the direct return costs are borne by the Consumer, except in the case of a non-conforming or defective product or an error attributable to RODIER.
Where RODIER offers a return solution or label, the applicable terms and cost are indicated to the Consumer at the time of their request.
8.8 Defective products or picking errors
No return costs may be charged to the Consumer where the return is made necessary by a non-conforming or defective product, a product damaged during delivery, or an error attributable to RODIER, under the conditions provided for by the applicable regulations.
The Consumer is invited to contact customer service beforehand, stating their order number, the product reference and, where possible, attaching photographs enabling the defect to be identified.
8.9 Condition of returned products
The Consumer is permitted to try on the products under the same conditions as they could in a shop.
The products must be returned with care and, as far as possible, together with their labels, accessories and any packaging.
The Consumer may be held liable in the event of any diminution in the value of the product resulting from handling going beyond that necessary to establish its nature, characteristics or proper functioning.
8.10 Exceptions to the right of withdrawal
In accordance with Article L. 221-28 of the French Consumer Code, certain products may be excluded from the right of withdrawal, in particular products made to the Consumer's specifications or clearly personalised, as well as products unsealed after delivery which cannot be returned for reasons of hygiene or health protection.
Where an exception applies to a product offered by RODIER, this information is communicated to the Consumer before the order.
8.11 Proof of return
The Consumer must keep their proof of deposit or dispatch until their return and refund have been completed.
Where they use the return label provided by RODIER and the parcel has been duly taken over by the carrier, RODIER will, in the event of a transport anomaly, take the necessary steps with the carrier upon presentation of the proof of deposit.
If the Consumer chooses to use a return method other than the one offered by RODIER, it is for them to keep any proof establishing the dispatch of their parcel.
8.12 Refund
Where the right of withdrawal is exercised, RODIER refunds the sums due to the Consumer in accordance with the applicable regulations.
Where the withdrawal relates to the entire order, the refund also includes the initial delivery costs corresponding to the standard delivery method offered by RODIER.
Additional costs resulting from the Consumer's choice of a delivery method more expensive than the standard method offered are not refunded.
The refund is made without undue delay and at the latest within the applicable legal time limits.
For sales of goods, RODIER may defer the refund until the products have been recovered or until the Consumer provides proof of their dispatch, whichever occurs first.
After receipt and inspection of the return, RODIER endeavours to process the refund within 3 working days.
An additional banking delay may be necessary before the amount appears in the Consumer's account.
The refund is made using the same payment method as the one used for the initial order, unless the Consumer expressly agrees to another method that does not incur any additional costs.
8.13 Exchanges and credit notes
RODIER also offers, as a commercial service and depending on the features available on the Site, the possibility of making an exchange or choosing a credit note.
These options are optional and never deprive the Consumer of their legal right to obtain a refund when validly exercising their right of withdrawal.
Depending on the options offered at the time of the request, the Consumer may in particular:

exchange a product for the same model in another size or another colour, subject to availability;

choose another product of a lower price, the difference being refunded;
-
choose a product of a higher price, subject to payment of the difference;

choose a credit note in order to use it later on the Site.
Where an additional payment is required, the Consumer is invited to settle it via the secure payment solution offered.
The exchange is confirmed subject to payment of any price difference and to the availability of the product concerned.
The direct return costs provided for in these GTC remain applicable to the exchange where they are borne by the Consumer.
Article 9 – Legal guarantees
RODIER SAS is the trader responsible for the legal guarantees relating to the products sold on the Site.

9.1 Legal guarantee of conformity
The Consumer benefits from the legal guarantee of conformity for a period of two years from delivery of the product.
During this period, they need only establish the existence of the lack of conformity.
The Consumer may request repair or replacement of the product, under the conditions provided for by the French Consumer Code. Bringing the product into conformity takes place free of charge, without major inconvenience to the Consumer and within the applicable legal period.
Where a product is repaired under the legal guarantee of conformity, the initial guarantee is extended by six months.
Where the Consumer requests a repair but the seller imposes a replacement, the replaced product benefits from a new two-year legal guarantee period from its replacement.
In the situations provided for by law, in particular in the event of refusal to bring the product into conformity, exceeding the legal period, major inconvenience or persistence of the defect, the Consumer may request a price reduction or termination of the contract.
In the event of a sufficiently serious defect, these remedies may be implemented without prior repair or replacement.
Termination of the sale is not available where the lack of conformity is minor.
Any period during which the product is unavailable with a view to its repair or replacement suspends the remaining guarantee period until the conforming product is delivered.
These rights arise from Articles L. 217-1 to L. 217-32 of the French Consumer Code.
9.2 Legal guarantee against hidden defects
The Consumer also benefits from the legal guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.
This guarantee may be exercised for a period of two years from discovery of the defect.
Under the conditions provided for by law, it may allow the Consumer to keep the product and obtain a reduction in its price, or to return the product and obtain a refund of the price paid.
9.3 Implementation of the guarantees
For any request relating to a legal guarantee, the Consumer may contact RODIER at the address:
Where a lack of conformity or a defect covered by a legal guarantee is established, the costs necessary to bring the product into conformity are borne by RODIER under the conditions provided for by law.
Article 10 – Liability
RODIER is responsible for the proper performance of its contractual obligations under the conditions provided for by the applicable regulations.
RODIER may not, however, be held liable for non-performance or improper performance of the contract where this is attributable to the Consumer, to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.
No provision of these GTC may have the effect of limiting or excluding the mandatory rights granted to the Consumer by law.
Article 11 – Personal data
In connection with the management of orders, payments, deliveries, returns, exchanges, customer relations and the other services offered on the Site, RODIER processes personal data.
This processing is carried out under the conditions described in the Privacy Policy accessible on the Site.
The Consumer has, under the conditions provided for by the applicable regulations, in particular rights of access, rectification, erasure, restriction, objection and, where the legal conditions are met, portability of their data.
The procedures for exercising these rights are set out in the Privacy Policy.
The Consumer also has the right to lodge a complaint with the French Data Protection Authority – CNIL, or, where they reside in another Member State of the European Union, with the competent supervisory authority.
Article 12 – Complaints and consumer mediation
12.1 Prior complaint
In the event of a difficulty relating to an order or to the application of these GTC, the Consumer is invited to contact RODIER customer service as a priority:

12.2 Consumer mediation
In accordance with the provisions of the French Consumer Code on the amicable settlement of disputes, after a prior written approach to RODIER has remained without a satisfactory solution, the Consumer may refer the matter free of charge to the consumer mediator to which RODIER belongs:

The Consumer is invited to consult the website of the FEVAD Consumer Mediator for the conditions and procedures for referral.
Article 13 – Applicable law and competent courts
These GTC are governed by French law.
Where the Consumer resides in another Member State of the European Union, the application of French law may not deprive them of the more protective mandatory provisions available to them under the law of their country of residence where these are applicable.
In the event of a dispute and failing an amicable resolution, the Consumer may bring the matter before the competent court in accordance with the applicable legal rules.

Within the framework of the obligations relating to extended producer responsibility, RODIER declares the following unique identifiers:

This information may be updated in accordance with regulatory obligations and the eco-organisations to which RODIER belongs.
Article 15 – General provisions
If any of the provisions of these GTC were to be declared void or inapplicable, the other provisions would remain fully applicable.
The fact that RODIER does not rely, at a given time, on one of the provisions of these GTC may not be interpreted as a waiver of the right to rely on it subsequently.
